Should juries or judges have more say in sentencing a convict to death?

On Tuesday, September 2, 2003, the federal appeals court in San Francisco changed over 100 death penalty sentences into life sentences. The sentences were changed due to a U.S. Supreme Court ruling that only juries, not judges can make factual determinations in death penalty cases.
